Jessica Yaniv Simpson vs. VCHA Certificate of Readiness

Jessica Yaniv Simpson, legal genius and conqueror of calories, has filed a Certificate of Readiness in their lawsuit against Vancouver Coastal Health Authority. This document states that JY is “ready to discuss settlement of (their) claim” and, most importantly, includes all medical reports and records of expenses or losses incurred or expected.

There’s 14 pages of material here, which you can read yourself at the link at the bottom of this post. Our page-by-page review starts in a minute, but first, a reminder on what exactly JY is claiming in his lawsuit. These documents are the evidence he’s providing to support his claim.

  1. JY states that the Three Bridges Clinic nursing team did not perform silver nitrate treatments for hyper granulated tissue properly.
  2. JY states, “at all material times the nursing team at Three Bridges Clinic were destined to inflict me harm”.
  3. JY states that this was influenced by a certain (unnamed) contractor that “meddled” with his surgery since 2019 due to her personal beliefs.
  4. JY states that Dr. Ruth Vilayil at another clinic performed the treatments properly.
  5. JY states that Dr. Vilayil, a different provider at a different clinic (Ridge Meadows Rapid Access), and GRS Montreal told him that Three Bridges procedure was incorrect.
  6. JY states he lost time at work (Mr. Swirl) because of this.
  7. JY states that he was unable to perform daily living tasks due to discomfort, inability to sleep, or care for himself.
  8. JY states he spent $500 for cabs and parking.
  9. JY is claiming “quantum damages” of $35,000 for inappropriate conduct and malpractice, plus $4,000 for damaged bedding.
  10. JY states he suffered suicidal ideation, extreme anxiety, stress, and PTSD.

Ten key claims / allegations made by JY, and now the evidence he states supports these claims. I’ll do this in the following format:

Synopsis: a summary of the page.

Claims Supported: a list of which claims, #1-10 above, this page supports.

You’ll note some items have been redacted. These include personal health numbers, insurance numbers, etc.

Synopsis: patient demographics printout, transsexualism, sexual deviations and disorders. A long list of meds including Ozempic, Gabapentin, Mar-amitriptyline, Metformin, Auro-cyclobenaprine, medroxyprogesterone acetate, risperadone, bupropion, rosuvastatin, gliclazide, insulin glargine, estradiol. Patient is hard of hearing, diabetic, dyslipidemia, 2x benign brain cysts.

Claims Supported: None.

Synopsis: Notes from Dr. Vilayil from three appointments on March 2021. Jessica’s appearance is “abdomen overweight”. Vulva is well healed. There is hypergranulation tissue on the cheeks behind the opening. There is a thin band of tissue across the opening, splitting it into two openings. UTI symptoms. Encouraged to continue sitz baths (reminder: in Feb 2021, JY was reprimanded by the Township for making over 30 calls for firefighters to lift his overweight abdomen from the bathtub because he was taking baths, not sitz baths). Dr. Vilayil says she discussed JY with someone at Three Bridges and they referred JY to a plastic surgeon. JY’s “vaginal bleeding” is increasing. Three Bridges Clinic also noted blood. JY is still at work. Pain is ok.

Claims Supported: None. Possibly contradicts #6. Dr Vilayil and Three Bridges seem in agreement, contradicting #1-3, 5.

Synopsis: Brown and sticky mixed fluid leaking. Requested notes from Three Bridges. Dilating with size 2. Daily bleeding and discharge. Can’t find her clit. Hypergranulation is improving. Dr Vilayil cannot duplicate care JY is receiving from Three Bridges. Miriam attended some appointments. No external hypergranulation as of June. Unable to dilate. By June, Dr Ruth was able to apply silver nitrate herself (AgNo3). Continued on top of next page…JY and Miriam are upset over the collapse of the neovagina due to lack of dilation. JY told to buy the smallest dilator and use daily. If not, remaining 4cm opening will close up. 4cm depth.

Claims Supported: No reference to any previous improper silver nitrate treatment. All references to hypergranulation say it is improving.

Synopsis: Told to keep dilating. Attended OBGYN with Miriam again. Stenosis (narrowing) of the neovagina. Too much pain to dilate. Went to ER with fever and chills. Referred to plastic surgeon. Abdomen overweight. No hypergranulation externally, well healed. 5 cm depth. Shooting pain when dilating.

Claims Supported: None.

Synopsis: This is from February 2021. Had to take ambulance to ER due to bleeding. Significant pain. Chronic pain from motor vehicle collision. ER doc had to insert a vaginal stent to hold the neovagina open. JY couldn’t handle it so they had to use a 50% size stent. Given instructions to use pads and monitor bleeding.

Claims Supported: None. In fact, Dr Vilayil originally recommended Three Bridges Clinic to treat JY.

Synopsis: Returned to ER 1 day later. Stent fell out after 6 hours. Lots of stinky discharge. Told to dilate and douche. Given instructions to use pads and monitor bleeding.

Claims Supported: None.

Synopsis: A final outpatient report from Dr. Genoway (plastic surgeon). Previously saw JY to “release” skin bridge (the one that created two openings). States JY has been to several emergency departments to complain about the neovagina condition. Very little hypergranulation. Told to keep dilating and perform pelvic floor exercises. No revision surgery is needed. 10 cm depth. Does not desire penetrable intercourse.

Claims Supported: None.

Synopsis: Document is from March. Refers to skin bridge in January. Trouble dilating. Claims to have recent motor vehicle collision which requires him to wear a hip brace. Has been attending Three Bridges regularly for treatment of hypergranulation. Normal clitoral complex and labia minor. Significant internal hypergranulation. Skin bridge was divided today. Perineum is tense. Ongoing followup with Three Bridges is planned.

Claims Supported: None. Contradicts claim that Three Bridges was harmful.

Synopsis: Miriam emailed Dr Vilayil saying that JY is being obstructed by “some individuals”. Describes family medical history of Mitochondrial disease complex IV deficiency affecting herself, her mother, and her sister. Says this could be connected to the vaginal wall collapse and wants referral. Says Dr. “Genovase” is on holidays and they are unwilling to help. (note that Dr. GenoWAY was the plastic surgeon). Says JY is stressed.

Side note…note that Miriam is using [email protected] as an email address. Feel free to send her your best wishes.

Claims Supported: It’s not exactly evidence, but it’s a witness report saying that JY is being obstructed and is experiencing mental health issues. I believe JY intends for this to support claims 2, 3, 7, and 10. From a legal perspective, these claims are just Miriam’s are not supported by any actual evidence.

Synopsis: Referral from RCH ER from July. Says JY is requesting a local expert to help maintain “vault opening”.

Claims Supported: None.

Synopsis: Record from ER visit above. Reason for visit is “unable to void”. Bleeding, vaginal collapse, stent fell out, etc. Diagnosis is post-op vaginal closure. Instructed to keep dilating.

Claims Supported: None.


Let’s refresh what JY’s claims were:

At no point in these documents does anyone say that Three Bridges performed the silver nitrate treatment improperly. In fact, he’s referred back there several times.

The only reference to a meddler is by Miriam, while she was writing an email to meddle.

His neovagina has healed up decently but closed off most of the way, apparently due to JY not following instructions to take sitz baths and dilate daily.

The only reference to JY’s work is that he was able to keep working.

The only reference to JY’s quality of life are by Miriam, saying he is stressed.

There are no receipts or records showing JY spent any money on cabs or parking.

JY was repeatedly told to use pads and cycle them out as he bled.

There is nothing here to support a claim of malpractice.

There is no reference to JY having suicidal ideations, extreme anxiety, or PTSD. The only mental health notes are that JY seemed upset, or Miriam saying he is stressed.
